Two Bruton High School 12th graders are facing felony drug charges after York County Sheriff’s deputies were called to investigate possible drug dealing in an elementary school parking lot.

York Sheriff’s Office Spokesman Mike Russell said deputies were called to the parking lot of Magruder Elementary in the 700 block of Penniman Road around 5:40 p.m. Thursday. They’d received a complaint about two subjects in a vehicle who were possibly engaged in drug activity, Russell said.

Deputies arrived and found two young men, Kevin W. Clark of the 600 block of Schooner Boulevard in upper York and Alexander L. Powers of the 4400 block of Mayflower Drive in James City County. Russell said the deputies “developed probable cause” to arrest the pair, both 18 years old.

Both were charged with possession with intent to distribute marijuana greater than one-half ounce and possession with intent to distribute within 1000 feet of a school, which are felonies. Clark has been charged with the additional felony possession with intent to distribute a schedule IV controlled substance.

York County Schools Spokeswoman Betsy Overkamp-Smith confirmed that both suspects are students at Bruton High School.

The division’s code of conduct for students lists a mandatory long-term suspension from 11 to 364 days, alternative education placement or expulsion as the minimum penalty both for possessing illegal drugs and for the “distribution or sale of illegal drugs and controlled substances or an attempt or conspiracy thereof.”

Both men were taken to the Virginia Peninsula Regional Jail. Clark was released on bond Friday; Powers bonded out over the weekend, a jailer said.
