JCC Supes Trying to Decide Process for Appointments

James City County’s Board of Supervisors will soon face a few difficult decisions: They will need to appoint a member to fill the board’s Jamestown District seat, and they will need to fill two planning commission seats.

They will need to do so with only four board members, two from each party.

The current Jamestown District Supervisor, John McGlennon, recently won the election to fill the seat in his new district, Roberts. The board will need to come to a decision on how to fill his vacated seat with a temporary appointment until a special election can be held next year.

If the remaining four members can’t come to a resolution in 30 days, a Circuit Court judge will have to make the appointment, according to Board Chair Mary Jones.

Board members are currently working on submitting their thoughts to County Administrator Robert Middaugh on what process the board should use to make the selection, Jones says.

The board will also need to agree on appointments for two expiring seats on the planning commission. Commission Chairman Jack Fraley’s Roberts District commission expires at the end of January, as does that of Jamestown Commissioner Joe Poole. It is up to the board to decide who fills the two positions, and they may still not have their fifth board member selected by the time the commissioners' appointments are due.

The board will choose from available applicants or can reappoint commissioners if they are interested in continuing, according to County Attorney Leo Rogers. The board will have appointees in place by February 1. Only the board can select a member of the planning commission, so should they be unable to agree the decision won’t fall to the court.

When the current board had to choose two planning commissioners in 2010, the decision became contentious. At the time, Supervisor Jim Icenhour bucked tradition and forced a vote on one member (read that story here).

I wonder how they will decide if they should rehear the 12/20/11 3:2 decision to move to quadrennial elections.

You see, I believe our Chair was overstepping her powers to make independent on the spot decisions as to what constitutes a "group" and why my group would not meet her standards and her actions simply further illustrates what I have labeled the "bully mentality and spiteful acts" that are now becoming common and easily recognized.

You see, this very power was drafted but never approved. It was denied. The Chair has way exceeded her board approved powers.

It is my understanding that tradition has the Supervisor from the same district as the seat on the Planning Commission brings forth a nomination, and by convention the other Supervisors should support such a nomination and then can expect such support when it is their turn to make an appointment.

Wonder what the actual history is of this tradition in recent years?

Jack Fraley is from Mr. McGlennon's district - Roberts.

Joe Poole is from the now vacant Jamestown district and could prove more contentious, or should be deferred until that seat is filled on the BOS.

That is my understanding of the situation.

This should be entertaining.

I think they should reappoint both of the Planning Commissioners. Jack Fraley has worked tirelessly to advance new ideas and open topics for discussion. Joe Poole has also served in an open minded manner.

Perhaps this is the first compromise these four could agree on. Not likely though.
